Merynn Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of the Merynn website, services, and retail operations. By accessing, browsing, or purchasing from Merynn, you agree to be legally bound by these Terms.

Merynn reserves the right to modify, update, or revise these Terms at any time without prior notice. Continued use of the website constitutes acceptance of such changes.

1. Use of the Website

By accessing the Merynn website, you represent and warrant that:

  • You are legally competent to enter into binding agreements.
  • You are at least 18 years of age.
  • Any information provided by you is accurate and complete.
  • Unauthorized use of this website may give rise to a claim for damages and/or constitute a criminal offense.

2. Definitions

“Jewellery / Silhouette” refers to pre-designed jewellery or jewellery set in gold with laboratory grown diamonds available for sale through Merynn’s website or authorized channels. All Jewellery is sold on an “as-is” basis, subject to product specifications.

“Mounts” refer to jewellery designs that hold diamond(s) in place and may or may not contain diamonds at the time of purchase.

“Loose Diamonds” refer to individual laboratory grown diamonds sold without being mounted.

Merynn reserves the right to modify product specifications without materially affecting quality.

3. Intellectual Property

All trademarks, logos, brand names, product names, text, images, designs, and content displayed on the website are the exclusive property of Merynn and are protected under applicable intellectual property laws.

No license or right to use any intellectual property is granted without prior written consent from Merynn.

4. External Links

The website may contain links to third-party websites. These links are provided for convenience only. Merynn has no control over external content and assumes no responsibility for it. Accessing third-party websites is at your own risk.

5. Product Representation

Due to screen settings, photography techniques, and display differences:

  • Products may appear slightly larger or smaller than actual size.
  • Colors may vary slightly.
  • Minor variations in metal weight or diamond weight may occur due to craftsmanship tolerances.

Such variations shall not constitute defects or grounds for legal claims.

6. Pricing & Market Fluctuations

Merynn pricing is calculated based on:

  • Prevailing gold market rates
  • Laboratory grown diamond prices
  • Making charges and applicable taxes

Since precious metal and diamond prices fluctuate, product pricing may change without prior notice.

The price applicable shall be the price displayed on the date of purchase or advance payment.

In case of minor variance between estimated and actual metal/diamond weight in the finished product, the difference shall be collected from or refunded to the customer accordingly.

7. Services & Membership

Certain services may require account registration. By registering, you agree to maintain confidentiality of login credentials.

Merynn reserves the right to suspend or terminate accounts for misuse, fraud, or breach of Terms.

8. Disclaimer of Warranties

The website and its content are provided on an “as available” and “as is” basis.

Merynn makes no warranties, express or implied, regarding:

  • Accuracy of website content
  • Continuous availability
  • Uninterrupted service
  • Error-free operation

9. Limitation of Liability

To the fullest extent permitted by law, Merynn shall not be liable for:

  • Any direct, indirect, incidental, or consequential damages
  • Loss arising from website access or inability to access
  • Delays, inaccuracies, or interruptions
  • Technical failures beyond reasonable control

Merynn shall also not be liable for transaction failures resulting from card authorisation decline due to preset limits with acquiring banks.

10. Cancellation Policy

  • Orders cancelled within 24 hours are eligible for full refund subject to 2% payment gateway charges.
  • Orders cancelled after 24 hours will incur:
    • ₹1,000 processing charge
    • 2% payment gateway charges

Customised or made-to-order products will incur forfeiture of making charges upon cancellation.

If an order contains multiple items, cancellation may apply to individual items without cancelling the entire order.

11. Returns & Refunds

Returns are governed by the separate Merynn Return Policy.

Refund processing:

  • Prepaid Orders: Refunded to original payment source.
  • Gift Card Purchases: Refunded back to gift card.

Free gifts are treated as discounts. In case of partial return, the value attributed to the free gift will be deducted from the refund amount.

12. Government Compliance

As per Government of India regulations, PAN details are mandatory for purchases exceeding INR 2,00,000 in a single day.

13. Offers & Promotions

  • Special offers are valid only on select designs.
  • Merynn reserves the right to amend or withdraw any offer without prior notice.
  • All promotional benefits are non-transferable and cannot be encashed.

14. Conflict of Terms

If any specific policy (Return Policy, Buy-Back Policy, Privacy Policy) conflicts with these Terms, the specific policy shall prevail for that subject matter.

15. Severability

If any provision of these Terms is deemed unenforceable, the remaining provisions shall remain valid and enforceable.

16. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India.

All disputes shall be subject to the exclusive jurisdiction of the competent courts in Bangalore, Karnataka, where Merynn’s registered office is located.
